Terms of Service

These Terms govern your use of the Moya app and moyahealth.app, provided by Moya Health Technologies Ltd ("Moya", "we", "us"), a company registered in England and Wales (company number 17322163), with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. By downloading or using Moya, you agree to these Terms. If you do not agree, please do not use the app.

Moya is not a medical device and does not provide medical advice. Moya is a wellbeing and self-tracking tool. It surfaces your co-occurring entries, the things you tend to log together, and draws no conclusions and makes no medical claims about any possible association. It does not diagnose conditions, recommend treatments, detect allergens, or replace professional medical care. Always consult a qualified healthcare professional about your health, and never disregard or delay medical advice because of something in the app. In an emergency, contact your local emergency services.

1. Who can use Moya

You must be at least 13 years old to use Moya. If you are under 18, you may use the app only with the consent and supervision of a parent or legal guardian. By using the app, you represent that you meet these requirements and that any information you provide is your own.

2. Your content

The information you record in Moya belongs to you and is stored on your device. You are responsible for keeping your device and any backups secure. We do not access the health information you store in the app.

3. Acceptable use

You agree to use Moya lawfully and not to misuse it, including by reverse-engineering the app, disrupting its infrastructure, or abusing the AI and lookup features. We may limit or suspend access where the service is misused.

4. Subscriptions, billing and free trials

Moya offers optional premium features through an auto-renewing subscription ("Moya Premium").

Billing. Payment is charged to your store account at confirmation of purchase, your Apple ID on iPhone or your Google Play account on Android. Prices are shown in the app in your local currency and may vary by region.
Auto-renewal. Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Your store account is charged within 24 hours before renewal.
Free trials. Where a free trial is offered, it converts to a paid subscription automatically unless you cancel at least 24 hours before the trial ends. Any unused portion of a trial is forfeited if you buy a subscription.
Managing and cancelling. You can manage or cancel your subscription in your Apple ID settings on iPhone, or under Subscriptions in Google Play on Android. Deleting the app does not cancel a subscription.
Refunds. Purchases are handled by the store you bought them from, and refunds are subject to Apple's or Google's policies.
Promotions. From time to time we may run promotions, such as making premium features free for a limited period. When a promotion ends, continued access to premium features requires a subscription.

5. Free version

Moya's core tracking features are free to use. Premium unlocks additional features such as advanced trends, exports and unlimited scanning. You are never required to subscribe to keep using the free version.

6. Intellectual property

The app, its design, branding and content (other than your own entries) belong to us and are protected by law. We grant you a personal, non-transferable, non-exclusive licence to use Moya under these Terms and, where applicable, your app store's end user licence terms (see section 10).

7. Third-party services

Moya relies on third-party services to provide certain features, including payments and app distribution through the App Store and Google Play, AI food recognition, subscription management, anonymous analytics, and product databases. Your use of those features may also be subject to the relevant provider's terms. How we handle data is described in our Privacy Policy.

8. Disclaimers

Moya is provided "as is" and "as available". AI-generated suggestions, such as ingredient estimates, are approximate and may be wrong. You are responsible for verifying them, and they must not be relied on for allergy, dietary or medical decisions. We do not warrant that the app will be uninterrupted or error-free, or that any information it shows is accurate or complete.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for any harm arising from reliance on the app's content or its AI suggestions. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud. Nothing in these Terms affects your statutory rights as a consumer.

10. App store terms

If you downloaded Moya from the Apple App Store. These Terms are between you and us, not Apple, and Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app is also subject to Apple's Licensed Application End User Licence Agreement, except where these Terms are more restrictive.

If you downloaded Moya from Google Play. These Terms are between you and us, not Google, and Google is not responsible for the app or its content. Your use of the app is also subject to the Google Play Terms of Service.

11. Changes and termination

We may update these Terms as Moya develops. If we make material changes, we will update this page and revise the date above. We may also change or discontinue features. You can stop using Moya at any time by deleting the app.

12. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory consumer protections that apply in your country of residence.
